Terms & Conditions of Sale

The Rosa Red web site allows us to display all the items which are available to buy. We have made every effort to photograph and display the jewellery as accurately and fairly as possible and to ensure that prices quoted are correct at the time of publishing. All prices are displayed inclusive of VAT. The items are described with weights and dimensions which are approximate only. We will only accept orders if there are no material errors in the description of the goods or their prices as advertised on this website. We make every effort to describe and display the colours of our items as accurately as possible, however, the images and the actual colours that you see will vary slightly depending on the monitor that they are viewed on, so we cannot guarantee that your monitor’s display of colour will accurately reflect the colour of the item that is delivered to you. To the extent permitted by applicable law, Rosa Red Ltd. disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. Rosa Red shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.
No contract will subsist between you and rosared.co.uk (the trading name of Rosa Red Limited) for the sale by it to you of any product unless and until rosared.co.uk accepts your order by e mail confirming that it has despatched your product. For the avoidance of doubt, any such contract will be deemed to have been concluded in the United Kingdom. Further, any such contract will be interpreted, construed and enforced in all respects in accordance with the laws of Scotland, and you and rosared.co.uk irrevocably submit to the non-exclusive jurisdiction of the Scottish Courts.

Ordering errors

You are able to correct errors on your order up to the point at which you click on ‘submit’ on the final page of our ordering process.

Availability

We aim to keep all items in stock and available to order at any time. From time to time due to the nature of our supply chain, some items may become un-available. These will be shown on the site as “out of stock”. Unfortunately it will not be possible to purchase these items from the site.

There may be a rare occasion when our stock records are inaccurate, and you are able to place an order through the site for an item that we do not have in stock. This means that your order is an offer, and not a contract of sale between yourself and Rosa Red Limited. We will contact you as soon as possible via e mail if the items you have ordered are not available. You will then be given the opportunity to wait until the item is delivered, change or cancel your order.

These terms and conditions cannot be varied except by changes which may be made from time to time by Rosa Red on the site. In particular, nothing said by any representative of Rosa Red will operate as a variation to these terms & conditions or constitutes a legal representation on behalf of either of them.

Price and availability information is subject to change without notice.

Credit Card Security
Rosa Red accepts all major credit and debit cards including Visa, Mastercard and Maestro. Our payment service provider is Sage Pay.

Your payment and order details are sent to us across a secure connection to Sage Pay online payment service provider. All information is collected and encrypted on a secure server. Sage Payx provides a secure environment approved by Lloyds/TSB Cardnet to take and process payments on our behalf.

When you proceed to our payment page, you can see that the pages are secure because the address in the address bar changes from being http:// to https://. You will also see a padlock symbol or key in the bottom bar of your browser. This means that all details are confidential while input on the Internet and stay confidential when passed to Sage Pay. We never see your card details. Sage Pay is the only person/system to see these details and we only reference your card using your order number. Even if we do a refund to you, we do not physically see your card details.

As an extra security measure, your credit card details will not be retained on our secure servers, this is why you must re-enter your card details each time you purchase anything from the site.

You will receive an e mail notification once your payment has been received.

Order Offline
If your unhappy about ordering online, then you can always order over the telephone by contacting us on 0141 572 7297.
Payment by cheque
If you prefer, you may order online and pay by cheque. Simply place your order online enter your details, and at the payment page select pay by cheque. Print out your order and send payment by cheque or postal order to us at:

Once payment has been received and cleared (which normally takes 5 working days) your order will be dispatched.

Delivery
We aim to dispatch most orders, once accepted within one working day. In the unusual event that we are experiencing an unusually high demand for an item which delays delivery, we will contact you via e mail with a revised delivery date. You will also have the option to cancel your order.
No order will take longer than 72 hours to dispatch, unless we advise you by e mail to the contrary.
All items will be packaged in a free organza gift bag.

Late/Lost Deliveries

If your delivery is late, please contact us at info@rosared.co.uk.  We make every effort to deliver within the times stated within the website, but we will not be liable for any loss caused to you by late or lost delivery.

Returns Policy

Unwanted items
We want you to be completely happy with your purchase of Rosa Red jewellery that is why we offer a 14 day no quibble money back guarantee. If for any reason you are not happy with the item(s) you have received, then we are happy to exchange them or give you a full refund provided:

  • The items that re returned have not been worn and are not damaged
  • Items are returned with all the original packaging, including the organza bags(s)
  • Items returned are in a re-saleable condition
  • Proof of purchase and original documents are returned with the items
  • Returns are made within 14 days of receipt of your order.

In the interests of hygiene we are unable to exchange or refund earrings for pierced ears.
This does not affect your legal rights.

We will require you to pay for the return postage to us. As you will be responsible for the item(s) until they reach us, we recommend that, for your own protection, you use a secure delivery method which requires a signature upon delivery e.g. Royal Mail Recorded Delivery.

We take great care when picking and dispatching your order. If, by any chance, you receive any item(s) that you have not ordered, a full refund or exchange will be given. In the case of an exchange, please follow the returns procedure. The correct item(s) will then be sent out immediately on receipt of your return.

Faulty items
Quality is very important to us, and all our products are checked thoroughly before dispatch to you. In the unlikely event that your goods are faulty, please contact us atinfo@rosared.co.uk and return the item(s) to us within 14 days of receipt.

We aim to refund all debited monies within 5 working days of receiving returned goods. Please, however, allow up to a maximum of 30 days.

Refunds will be at the purchase price i.e. nett of any discounts and special offers. We will not refund postage costs. All refunds will be made to the purchaser via the payment method used when the order was placed.

Cancellation Right
Under the distance selling regulations you have the legal right to cancel your order within 7 working days of receipt of the goods.

Damage to your computer
Rosa Red makes every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it won't cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and screen out anything that may damage it. Rosa Red shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.
